The Issue of Apostasy in Light of Taha Jabir Al-Alwani’s Maqāṣid-Based Qur’anic Perspective

Open access
Halim Bichi, Mohammed Abdel·2026·Al-Bayan: Journal of Qur'an and Hadith Studies

Abstract

The issue of intellectual and religious freedoms has occupied the mind of the contemporary Muslim, and numerous writings have emerged on the question of apostasy and its apparent conflict with freedom of belief. Juristic and intellectual responses to these modern challenges have differed: some continue to uphold the majority opinion of classical jurists mandating the execution of the apostate, while others re-examine the issue through alternative lenses – most importantly the Qur’anic framework and the higher objectives of Islamic law. From this standpoint arises the central question of this study: what foundational, maqāṣid-based, and juristic contributions did Dr. al-‘Alwānī offer regarding freedom of belief and the issues of apostasy and conversion? To explore this, the research employs descriptive and analytical methodologies. The study concludes by highlighting al-‘Alwānī’s key principles in affirming freedom of belief and critiquing the juristic opinions that assert the existence of a fixed legal punishment for apostasy, as well as his critique of the hadith-based evidence for such a ruling. His position is grounded in his view of the primacy and supreme authority of the Qur’an in deriving legal rulings, with prophetic traditions and practical Sunnah serving to elucidate Qur’anic verses – without yielding to foreign cultural influences or temporary socio-political pressures.

TL;DR

This study reconstructs and analyzes Ṭāhā Jābir al-ʿAlwānī's maqāṣid-based, Qur'an-centered argument that apostasy (ridda) carries no fixed Qur'anic worldly penalty, and that the juristic consensus and hadith evidence for executing the apostate are methodologically unsound. It situates his ijtihād within modern Islamic debates on freedom of belief and contrasts it with the majority position and with other reformist responses.

Key findings

  • Al-ʿAlwānī holds that the Qur'an prescribes no worldly punishment for apostasy, only the voiding of works; the paper reports his claim that affirming a death penalty for apostasy would entail suspending or abrogating "nearly two hundred verses" (mā yuqārib miʾatay āya) that establish freedom of belief.
  • He reduces the eight schools' (al-madhāhib al-thamāniyya) evidence for a fixed ḥadd to two pillars — transmitted hadiths, chiefly "whoever changes his religion, kill him," and a claimed ijmāʿ — and argues the ijmāʿ is invalid because it conflates political and doctrinal apostasy, and is contradicted by reports from ʿUmar b. al-Khaṭṭāb, al-Nakhaʿī, and al-Thawrī allowing perpetual istitāba.
  • He reads the ḥadīth "the one who separates from his religion, the one who leaves the community" as tied to ḥirāba/leaving the community, not to purely intellectual apostasy; the paper cites Ibn Taymiyya ("this only occurs through fighting") and al-Nawawī as divergent readings.
  • The Treaty of Ḥudaybiyya is presented as key evidence: the Prophet accepted that Muslims who defected to Quraysh would not be returned, which al-ʿAlwānī takes to show apostasy falls under discretionary political policy (siyāsa sharʿiyya), not an irrevocable ḥadd. The paper cites Ibn al-Ṭallāʿ: "It is not recorded in any of the well-known compilations that he ﷺ killed an apostate or a heretic."
  • The paper notes al-ʿAlwānī's position was triggered by the 1963 Iraqi Baʿthist demand to execute 5,000 communists on apostasy fatwas.

Methods

  • Descriptive and analytical study of al-ʿAlwānī's writings, with partial comparison to opposing juristic views, drawing on primary sources (chiefly his *Lā Ikrāh fī al-Dīn*, *Maqāṣid al-Sharīʿa*, *Al-Waḥda al-Bināʾiyya*, *Naḥwa Mawqif Qurʾānī min al-Naskh*).
  • The paper surveys modern Islamic responses to apostasy in three categories: juristic defenses of the majority view, foundational/philosophical studies of freedom of belief, and direct engagements with the apostasy problem.
  • It reconstructs al-ʿAlwānī's argument by examining his Qur'anic lexical survey of ridda, his critique of the juristic classification of apostasy across the eight schools' manuals, and his hadith-critical re-reading of both prophetic practice (sīra) and verbal reports.

Limitations

  • The paper states no explicit limitations section. It does note that no prior study treats apostasy in al-ʿAlwānī through this maqāṣid lens, and that the closest comparable work (by ʿAlī Akbar) does not fully set out al-ʿAlwānī's foundations or link them to his ijtihād.
  • The text makes evident that the study is confined to al-ʿAlwānī's own corpus and to partial comparison with opponents, rather than a systematic comparative or empirical treatment.
  • The author himself flags gaps in al-ʿAlwānī's survey: he "omitted" apostasy incidents at the change of the qibla, Jewish apostates, the Bedouin who sought release from the pledge, and the objector to the division of spoils; and he "stopped short" of exploiting two important evidences — the hypocrites (Munāfiqūn) and the Ḥudaybiyya clause — which the author says could have strengthened his case.

Al-Alwani affirms the impossibility of contradiction between the Sunnah and the Qur'an, let alone the possibility of the Sunnah abrogating the Qur'an, saying that what is established in the Qur'an is clarified by the Sunnah when people need clarification by prophetic saying, action accompanied by saying, or bare action explaining application or approval, and it supports and complements it.

Al-Alwani's analysis of the juristic classification of apostasy shows that the eight schools vary in characterizing it as a fixed punishment, discretionary punishment, Sharia policy estimated by the ruler, or a punishment varying by the apostate's circumstances, and this hesitation is evident in the placement of apostasy in juristic compilations.

    § Abstract

For any physical punishment in Islam to be established, it must appear in the Quran, or what explains it in the Sunnah, or consensus of the Companions, and this is known and agreed upon by jurists.

“: لثبوت أي عقوبة بدنيّة في الإسلام، فلا بدّ من ورودها في القرآن، أو ما يبيّنها في السنّة، أو إجماع الصّحابة، وهي معلومة اتّفق عليها الفقهاء.”

For that reason, Al-Alwani's foundational jurisprudential review came from within the source texts, with usuli methodology, showing ability and capacity in utilizing texts and grounding the topic from its legitimate doors without submitting to the dictates of Western thought or prostrating before it under the pretext of its precedence in rights and freedoms.

“ولأجل ذلك جاءت المراجعة الفقهيّة التّأصيليّة للعلواني من داخل النّصوص المصدرية، وبالمسطرة الأصوليّة، مبينا عن قدرة ومكنة في استثمار النّصوص، وتأصيل الموضوع من أبوابه المشروعة دون الخضوع لإملاءات الفكر الغربيّ، أو الانبطاح أمامه بحجّة سبقه في قضايا الحقوق والحريّات.”

    § Abstract

No punishment for apostasy appears in the Quran despite 200 verses establishing freedom of belief and prohibiting compulsion; apostasy events are established in the biography, but it is not established that the Prophet imposed a hadd or killed anyone; the mentioned few events go back to additional criminal or political reasons; the claimed consensus is broken by the opinion of Umar ibn al-Khattab,

The old social pattern did not tolerate separation between religious and social commitment, which makes killing the apostate justified by these considerations.

“لأنّ النّمط الاجتماعيّ القديم لم يكن يتحمّل الفصل بين الالتزام الدّينيّ والاجتماعيّ، وهو ما يجعل قتل المرتدّ مبرّرا بهذه الاعتبارات.”

    § Abstract

Based on the foregoing, the hadith does not definitively indicate establishing a hadd for mere apostasy; rather its context is apostasy coupled with warfare and corruption, which are crimes with their prescribed hudud. As for purely intellectual apostasy, the hadith does not include it, and it requires another stance.

“وبناء على ما تقدّم فإنّ الحديث لا يقطع في دلالته على تقرير حدّ للردّة المجرّدة، وإنّما سياقه في اقتران الردّة بالحرابة والإفساد، وهي جرائم لها حدودها المقرّرة، أمّا الردّة الفكريّة المجرّدة فإنّ الحديث لا يعمّها، ولا بدّ لها من موقف آخر.”

The issue of apostasy has remained one of the perplexities for Islamic thought, in terms of its conflict with the authenticity of freedom of belief in Islam.

    § Abstract

Al-Alwani's uniqueness in the issue is his utilization of Sharia texts, reading them with structural and methodological unity that maintains the supremacy and sourcehood of the Quran for Sharia rulings, and embodying his thesis in the mutual support of hadiths and actual Sunnah in clarifying Quranic verses, without submitting to the dictates of foreign cultures or to temporal variables, and

The extant historical reports (sira, hadith compilations) are sufficiently complete to establish the absence of a case where the Prophet applied the apostasy hadd to mere apostasy.

The Hudaybiyyah treaty's provisions can serve as a normative legal precedent for apostasy rulings in later times.

About these checks

Registry, retraction, Cites and statistics results are computed, not judged, with one exception: a printed reference that no index lists is read once by a model before it counts as a citation error. Claims are extracted by a model and kept only when their quote appears verbatim in the text; each cited source is then checked, with a model’s help, for whether it says what the claim relies on. Those verdicts can be wrong — read the claim’s quote and the cited source before relying on one.

Claims read by deepseek-v4.1-flash under definition version 3 (extract-v3) on 2026-10-26.

Classified by jev-1.13-20260917 (gold-guideline-v0.2) on 2026-10-26.

Statistics and arithmetic are recomputed, not judged.

Confidence bands are shown only for fields calibrated on our annotated test set. None is calibrated yet, so no band is shown.
