Open access
Khalfoune, Tahar·2021·Revue internationale de droit comparé

Abstract

TL;DR

The paper asks whether Algeria’s 2020 constitutional revision marked a break from or continuity with authoritarian constitutionalism, and concludes that despite official claims of a “new republic,” it largely preserved and even reinforced presidential dominance. It finds expanded rights language and some institutional changes, but argues their effectiveness is undermined by weak separation of powers, a subordinate judiciary, and the military’s extra-constitutional role.

Key findings

  • The revision is presented as a rupture, but the author finds continuity: the president retains or gains control over defence, foreign policy, interior, justice, constitutional revision, referendums, ordinances, appointments, emergency powers, regulatory authorities, troop deployment abroad, early presidential elections, and convocation of the electorate, without parliamentary control, countersignature, or political responsibility. The main reductions are the two-term limit already restored in 2016 and a hypothetical cohabitation scenario.
  • Rights are formally expanded: Title II (arts. 34–77) recognises roughly twenty new rights and liberties, including simple declaration for meetings and associations, judicial dissolution of associations/parties, administrative silence as acceptance, access to information, fair trial, compensation for arbitrary detention or judicial error, and protection of women from violence. The author argues these remain weakly effective because of repression, media censorship, and arrests: over 1,000 people faced judicial proceedings and about 90 remained in prison for hirak-related acts according to the CNLD; journalist Khaled Drareni was sentenced to two years, and Yacine Mebarki’s ten-year sentence was reduced on appeal to one year.
  • The Constitutional Council becomes a Constitutional Court with 12 members, including six constitutional law professors elected by peers and four members appointed by the president, who also names its president and holds a casting vote; the priority constitutionality question is extended to ordinances and regulations. The author notes the court had not been installed six months after promulgation and that presidential appointment gives the head of state a blocking minority.
  • The army is mentioned four times in provisions, six times in the preamble, and six times in the text; art. 30.4’s reference to “vital and strategic interests” is criticised as vague and potentially constitutionalising a political role. The paper notes that five of eight heads of state were army officers and that 22 February is designated a national day of fraternity between the people and the army, while the hirak’s demand for a civil, non-military state is absent.

Methods

  • Doctrinal and comparative legal analysis of the 2020 Algerian constitutional text, the expert committee’s draft and mission documents, official discourse, and prior Algerian constitutions (especially 1963, 1976, 1989, 1996, 2008, 2016).
  • Contextual analysis of the hirak, the 2019 presidential election, the 1 November 2020 referendum, and the June 2021 legislative elections, using official turnout figures: 39.93% in 2019, 23.7% in the referendum with 66.8% approval, and 23% in June 2021.
  • Comparison with Morocco, Tunisia, France, and the United States to assess rupture versus continuity in constitutional design and practice.

Limitations

  • The paper does not state formal limitations.
  • Evident from the text: it is a normative and doctrinal essay rather than an empirical study, relying heavily on press reports, official figures, and the author’s interpretation of constitutional practice.
  • Evident from the text: the analysis is single-country and advocacy-oriented, with a clear preference for a constituent assembly and a break from the 1976 constitutional matrix; comparative references are selective and used to support the argument rather than to test it systematically.

Claims are extracted by a model and kept only when their quote appears verbatim in the text; each cited source is then checked, with a model’s help, for whether it says what the claim relies on. Those verdicts can be wrong — read the claim’s quote and the cited source before relying on one.

Claims read by deepseek-v4.1-flash under definition version 3 (extract-v3) on 2026-10-06.

Classified by jev-1.13-20260917 (gold-guideline-v0.2) on 2026-10-06.

Statistics and arithmetic are recomputed, not judged.

Confidence bands are shown only for fields calibrated on our annotated test set. None is calibrated yet, so no band is shown.
