Abstract

Written from the paper’s full text.

TL;DR

The paper maps Argentine Supreme Court (CSJN) rulings from 2013–2020 in which the state was sued over the right to housing, finding that most housing cases were dismissed and that the Court selected only extreme-vulnerability cases. It concludes that the remedies adopted were weak and that dialogic/structural litigation is needed.

Key findings

  • Of 187 CSJN housing-related results for 2013–2020, the paper reports that 20% were dismissed (48 of 187) citing only art. 280 of the CPCC; the annex instead says 31 of 187 were dismissed.
  • Only 6 of the 187 results met the selection criteria (CSJN ruling, 2013–2020, state as defendant for right to housing); 3 of the 6 were against the Government of the City of Buenos Aires.
  • The Court tended to take the “easiest” cases—those involving extreme vulnerability such as disability, serious health problems, older adults, minors in charge, or poverty—without defining “vulnerable groups.”
  • In none of the six cases did the CSJN issue a concrete, precise order definitively guaranteeing the right to housing; remedies lacked deadlines, follow-up, reports, or structural solutions, and 9 years passed after the 2012 “Q.C., S. Y.” ruling without an advanced pronouncement.

Methods

  • Systematic mapping of CSJN judgments from 2013–2020 in which municipal, provincial, or national state actors were sued for compliance with the right to housing, using searches in PJN, SAIJ, CIJ, CSJN web sources, jurisprudence bulletins, and doctrinal commentary with keywords such as “Derecho a la Vivienda.”
  • The identified cases and resolutions were compiled into a database and analyzed using “legal ethnography,” a documentary field method aimed at reconstructing the Court’s criteria from the judges’ practice.

Limitations

  • The paper does not state an explicit limitations section.
  • Evident from the text: the final sample is very small (6 cases), depends on keyword searches and documentary sources, and is restricted to CSJN decisions with the state as defendant.
  • The text also shows an internal inconsistency in the dismissal count (48 of 187 in the analysis vs. 31 of 187 in the annex) and notes that the Court never defines “vulnerable groups,” leaving that category to judicial discretion.

About these checks

Registry, retraction, Cites and statistics results are computed, not judged, with one exception: a printed reference that no index lists is read once by a model before it counts as a citation error. Claims are extracted by a model and kept only when their quote appears verbatim in the text; each cited source is then checked, with a model’s help, for whether it says what the claim relies on. Those verdicts can be wrong — read the claim’s quote and the cited source before relying on one.
